Terms of Use (EULA)

1. Parties and Acceptance

This EULA is entered into between you, the end user ("User"), and AylernAI (the "Company", "we"). For the version downloaded from the Apple App Store, Apple Inc. is not a party to this agreement but is a third-party beneficiary as set out in Section 13. By using the Service you represent that you are at least 18 years old, or that you have the consent of a parent or legal guardian.

2. License

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable and revocable license to use the App for your personal, non-commercial purposes on devices you own or control. This license requires continued compliance with the Apple Media Services Terms (or Google Play Terms, as applicable).

3. Account

Some features of the Service require you to create an account. You are responsible for providing accurate and up-to-date information, maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately if you become aware of any unauthorized access.

4. Acceptable Use

You agree to use the Service only in compliance with the law and these Terms. The following activities are prohibited:

• Reverse engineering, copying or modifying the Service.
• Using automated tools, bots or scrapers to access the Service without permission.
• Creating or sharing content that is illegal, hateful, harassing, sexually explicit or infringes on the rights of others.
• Attempting to make the AI tutors generate malicious code, harmful instructions or illegal content.
• Impersonating others or making misleading statements.
• Overloading the infrastructure or circumventing security measures.

We reserve the right to suspend or terminate your account and pursue legal remedies for any breach of these rules.

5. User Content and AI Outputs

Content you submit to the Service, such as messages, voice recordings and notes ("User Content"), remains yours. By submitting User Content you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use it for the purpose of providing, improving and supporting the Service. Responses generated by the AI ("AI Outputs") are statistical model outputs; we make no warranty as to their accuracy, appropriateness or completeness. You should not rely on AI Outputs alone for legal, medical or financial decisions.

6. Subscriptions, Fees and Auto-Renewal

The App offers free and paid (Pro) plans. When you purchase a subscription:

• Payment is charged to your Apple ID or Google account upon confirmation of purchase.
• Subscriptions automatically renew for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• The renewal charge is taken within 24 hours prior to the end of the current period.
• No cancellation of the current subscription is allowed during the active period; cancellation takes effect on the next renewal.
• You can manage and turn off auto-renewal in your Apple ID / Google Play account settings at any time.

Current prices are shown inside the App and on the store page. Prices may change; you will be notified before the change takes effect and your committed period remains protected.

7. Free Trial

Certain plans may include a free trial. If you do not cancel at least 24 hours before the trial ends, the plan will automatically convert to a paid subscription and payment will be charged. Any unused portion of a free trial is forfeited when you start a paid subscription.

8. Refund Policy

Because purchases are processed by the Apple App Store or Google Play, refund requests are subject to the applicable store's policy. Your statutory consumer rights (for example, the 14-day right of withdrawal under Turkish consumer law where applicable) are preserved. Outside of mandatory consumer-law protections, we do not guarantee refunds for used subscription periods.

9. Intellectual Property

All intellectual-property rights in the Service — including logos, software, text, graphics, audio content and the structure of AI models — belong to AylernAI or its licensors. These Terms grant you only a limited right of use; you may not copy, modify, sell or commercially redistribute any part of the Service without permission.

10. Third-Party Services

The Service may use or link to third-party services (for example, Apple / Google payment, analytics providers and AI model providers). Those third parties have their own terms and privacy policies that apply to your use of them. AylernAI is not responsible for the content or practices of third parties.

11. Changes and Termination

We reserve the right to modify, suspend or discontinue all or part of the Service with reasonable notice. We may suspend or terminate your account for a material breach of these Terms. You may terminate this EULA at any time by ceasing to use the Service.

12. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by applicable law, AylernAI's total liability to you shall not exceed the amount you paid to us for the Service during the 12 months preceding the claim. We are not liable for indirect, incidental, punitive or consequential damages.

13. Apple-Specific Terms (App Store Version)

The following provisions apply to the version of the App downloaded from the Apple App Store:

• This EULA is concluded between you and AylernAI only; Apple is not a party.
• AylernAI, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support; if any refund is required by applicable law, such refund will be limited to the price paid by you for the App.
• Third-party intellectual-property claims are the responsibility of AylernAI, not Apple.
• You represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce the EULA against you as a third-party beneficiary.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye. Disputes arising out of these Terms shall first be resolved through good-faith negotiation; failing that, they shall be submitted to the exclusive jurisdiction of the Central (Çağlayan) Istanbul Courts and Enforcement Offices. Mandatory consumer-protection rules remain reserved.

16. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, it will be interpreted or reformed to the extent necessary to comply with applicable law, while the remaining provisions remain in full force. These Terms constitute the entire agreement between the parties with respect to the subject matter hereof.
